1. Introduction

Welcome to Covered!

We know that you care how information about you is used and shared, and we appreciate your trust that we will do so carefully and sensibly. The services offered on our website, itscovered.com (the “Site”, as defined herein), are owned and operated by Covered Insurance Solutions, LLC (“Covered”). This Privacy Policy describes how Covered and its affiliates (collectively "Covered") collect and process your personal information through Covered websites, services, online marketplace, and applications that reference this Privacy Policy (collectively, the "Covered Services"). 

Please read this Privacy Policy carefully as it explains how we collect,  use, and share data about you. 

By using Covered Services, you are consenting to the practices set forth in this Privacy Policy.  This Privacy Policy applies to all Users of the Site and Service. If you do not wish to have your Personal Information collected, used or disclosed as set forth in this Privacy Policy, you must refrain from using our Site or the Covered Services or disclosing your Personal Information to us. You can review the most recent version of this Privacy Policy at any time here. We reserve the right to update, change or replace any part of this Privacy Policy by posting updates and/or changes.

2. Definitions

Throughout this Policy, we may use certain words or phrases, and it is important that you understand the meaning of them:

  • “Covered”, “we” or “us” refers to Covered Insurance Solutions, LLC;
  • “Policy” means this Privacy Policy;
  • “Service” or “Covered Services” refers to the services that we provide through the Site, including, but not limited to, our insurance quotation service and the Site itself. For clarity, Services may be provided by Covered through use of AI functions;
  • “Site” refers to the Covered website at itscovered.com, all of its sub-domains, any mobile renderings or counterpart mobile applications of such website, or any successor website(s) provided by Covered;
  • “User” refers to all visitors of the Site, including but not limited to registered and unregistered users, visitors, viewers, Covered customers, browsers, vendors, service providers and/or merchants; and
  • “You” and “Your” refers to you as an individual User.

3. Information Collected

We collect “Personal Information,” which is information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with You or, Your household.

During your use of our Services, we may collect your Personal Information from a variety of sources:

  • From you: We receive and store information that You provide to create Your Covered account; for billing and payment; to provide, renew or discontinue the Covered Services; to evaluate Your eligibility for aspects of the Covered Services; and to interact with You, including responding to your inquiries.
  • From our financial institution partners: We work with and receive Personal Information from financial institution partners (such as retail and commercial banks, mortgage companies and credit unions) with whom we partner on facilitating product offerings to protect against risk of loss due to death, property damage, etc.
  • From our partners: We work with and receive Personal Information from third parties such as FinTech partners, service providers, and vendors. For certain business-to-business relationships, market researchers may also provide certain information and services.
  • From Your use of the Site: We collect and store information about your visits and use of the Site. Like many websites, we use “cookies”, logging technologies and other unique identifiers, and we obtain certain types of information when your web browser or device accesses our Site to optimize cybersecurity and the User experience.
  • From other sources: We may supplement the information above with information we obtain from other sources, including credit history information from credit bureaus, data used to help prevent and detect fraud, etc. In addition, we may obtain data from reputable third parties (e.g. Department of Motor Vehicles) and public records, as well as receiving information from state and local government agencies, other insurance agencies, carriers and brokers, etc.

 

 

The categories of Personal Information that we collect from you depend on your interactions and engagement with us. We may collect:

  • Direct Identifiers: We or our service providers may collect direct identifiers, such as your name, address, date of birth, social security number, drivers’ license number and information, IP address, online identifiers, email address, phone number, and other similar identifiers. We collect this information to provide the Service, maintain your account, verify your identity and information, communicate with you, process your payments, operate our business, and to otherwise communicate with you. We may provide this information to service providers and contractors, regulatory authorities, or to other third parties as required by law.
  • Information Subject to Protection Under California Law, such as the Identifiers above, your signature, and we or our service providers may collect your bank account number, credit card number, or debit card number. We use this information to provide you with our services, maintain your account, and to otherwise communicate with you. We may provide this information to service providers, regulators or to other third parties as required by law.
  • Protected Classification Characteristics, such as your gender and age. For more information, please see the "Sensitive Personal Information" description below.
  • Commercial Information: We or our service providers may collect commercial information such as a record of personal property, products or services obtained or considered, or other information related to purchasing or consumer histories and insurance claims. We use this information to better understand your use of the Service and for our internal business purposes. We may provide this information to service providers, regulatory authorities, or to other third parties as required by law.
  • Geolocation Data: We or our service providers may collect this information to provide you with the Service and to better tailor the Service to you depending on your geographical region. We may provide this information to service providers, contractors, regulators, or to other third parties as required by law.
  • Internet and other Electronic Activity Information: We or our service providers may collect your browsing history, search history, location of your device or computer, cookies, browser and device type, and information regarding your interactions with pages you visit on the Sites. We collect this information to understand your use of the Sites and your Account and for targeted marketing and lead management. For more information, see the “Data Collection Technologies”section below.
  • Audio, Electronic, Visual, Thermal, Olfactory or Similar Information: We or our service providers may collect this information, such as photos or videos, to provide the Service. We may provide this information to service providers, contractors, regulators or to other third parties as required by law.
  • Professional or Employment-Related Information, such as information about your current employment, salary, educational history. We collect this information to verify your identity, perform background checks, fulfill underwriting requirements of our carriers, and execute other related processes.
Some of the information we collect may be considered Sensitive Personal Information under privacy laws, such as your social security number, marital status, certain protected classification characteristics, and certain financial information. We do not use or disclose your sensitive Personal Information for any purpose other than as permitted by applicable law. If an insurance carrier and affiliated service network provider requires certain Sensitive Personal Information (namely,  social security number and/or marital status) in order to quote and/or bind a policy, we may share that information. We do not store social security numbers.

4. Use of Your Information

We may use or collect your information to:

  • Create, maintain or service your account, process and fulfill your requests, and perform other activities that are part of the Service;
  • Provide any services that you request or seek to purchase (including, but not limited to, sharing data with our insurance carrier networks for the purpose of facilitating a purchase of insurance on your behalf);
  • Conduct verification and background checks as part of our business acceptance, finance, administration, and marketing processes, including anti-money laundering, conflict, reputational and financial checks;
  • Enhance or improve the User experience, the Site, and/or the Covered Services, including by running analytics, improving our artificial intelligence tools, assessing the quality of the Covered Services, and for other related internal business purposes;
  • Develop additional products or services;
  • Contact you by phone, text or email about the Covered Services or respond to inquiries;
    Provide and troubleshoot the Services as it pertains to Site functionality and performance, as well as to analyze performance, fix errors and improve the usability and effectiveness of the Site and the Covered Services;
  • Send emails and updates about Covered, including newsletters and notifications of amendments to legal documents such as this Privacy Policy and our Terms and Conditions by email or text. You may opt-out of receiving certain promotional e-mail messages from us as described in this Privacy Policy;
  • Administering and improving the Site, including to measure the effectiveness of the Site, to customize the content and/or layout of our Site for each individual visitor, help diagnose problems with our server, see where Site traffic is originating, to identify our Site users, to track our visitors’ use of the Site for internal market research and to notify visitors about updates to the Site or Service;
  • Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection; maintain legal and regulatory compliance; and enforce compliance with our terms and conditions and policies;
  • Prevent and detect fraud and abuse in order to protect the integrity of the Site, the Covered Services and the security of our Customers and others;
  • Perform any other function that we believe in good faith is necessary to protect the security or proper functioning of the Site or Service.

5. Disclosure of Your Personal Information

Covered is not in the business of selling the Personal Information of our customers and Site visitors. Covered shares Your Personal Information only as described in this Privacy Policy and/or with controls that are analogous to and approximately as protective as the measures described in this Privacy Policy. Covered will not share your mobile telephone number with third party affiliates or marketing partners for marketing or promotional purposes without your consent. We may share your Personal Information with your consent (as disclosed to you at the time we collect it), as well as in the following circumstances:

  • Service Providers: We may provide your Personal Information to our service providers that help us run and manage our business, such as technology service providers, analytics providers, screening companies, collections agencies, customer service providers, and our credit card processors.
  • Regulatory authorities, including, state, or local insurance regulators as required by applicable law.
  • Financial services entities, including licensed insurance agencies within the Covered insurance marketplace, financial institutions, credit agencies, and other financial services entities that provide financial and auditing support services.
  • As Required by Law: We may disclose your Personal Information as required by law, such as to comply with a subpoena or similar legal process. Additionally, we may disclose Personal Information when we believe that disclosure is necessary to protect the safety and security of our property or the property of others. We may also disclose Personal Information to protect our rights, such as to investigate fraud or respond to a government request.
  • Corporate Transaction: In the event Covered is involved in a merger, reorganization, acquisition or sale of all or a portion of its assets, or other corporate transaction, we may transfer, assign, or disclose your Personal Information as part of that transaction.

6. Data Collection Technologies

We may use cookies, web beacons and other technologies (collectively, “Data Collection Technologies”) to enable our systems to recognize your browser or device and to help us personalize and enhance Your experience on the Site. Our Data Collection Technologies include:

  • Cookies: Cookies are small data files that are placed on your computer or other devices by websites that you visit and stored on that device’s hard drive. Our cookies allow us to personalize your experience on the Site, make your visit more convenient, and understand how you and others are using the Site to improve your experience on the Site. We may use cookies to remember your preferences, maintain user sessions, improve security of our services, collect usage information, and target ads. We may use various third-party services that may use cookies, web beacons, and similar technologies to collect information. Such services include, but not limited to, web analytics services, advertisement services, and social media services.
  • Web Beacons: A web beacon (also referred to as clear gif, pixel tag or single-pixel gif) is a transparent graphic image used in tandem with cookies that enables us to record a user’s actions. We use web beacons to count users who have visit pages on the Site, verify system and server integrity and for similar statistical measures.
  • Google Analytics and Other Analytics Tools: We use Google Analytics and other analytics tools (such as HotJar) to help us understand how users engage with our Service. Google Analytics uses cookies to track your interactions with our Site or Service, then collects that information and reports it to us, without identifying individual users. This information helps us improve our Service so that we can better serve users like you. For more information on Google Analytics, visit https://Support.Google.com/Analytics. Similarly, HotJar monitors website traffic holistically, as well as User drop-off data and other information, which helps Covered: (a) investigate and remove website friction; and (b) contextualize the User experience. Understanding website friction and the related user experience contextualization informs web design updates and website optimization, without identifying individual users.
Most web browsers automatically accept cookies, but it is possible to change your browser setup so that it does not accept cookies. To create a profile on the Site, you must have cookies enabled. To find out more information about cookies, visit https://www.AllAboutCookies.org.

7. Marketing Communications

Email communications

You can opt-out of receiving certain marketing email communications from us at any time. To do so, follow the unsubscribe link in the footer of the email or use the “Contact” section below. Opting out of marketing email communications does not mean Covered will not contact you about your account or the Service.


Voice calls, texts and SMS messages

You may have the opportunity to receive occasional voice, text and SMS messages from Covered. These may include updates on our products and services, or about products and services that we think may be of interest to you. Frequency will vary. By providing your phone number and opting in to receive text messages, you expressly consent to receive these communications. This includes automated text messages to the phone number that you provide. Consent to receiving text messages is not required to receive products or services from Covered. Message and data rates may apply, and your carrier's rates will apply. You can opt out of receiving future text messages or receive help by following the directions in the text message you receive. As Covered is located in the United States, international rates may apply depending on your location. We may disclose your mobile phone number to service providers with whom we contract to send you automated text messages. However, we will not disclose your mobile phone number to third parties or affiliates for their own marketing or promotional purposes without your express consent. Opting out of calls, texts and SMS messages does not mean Covered will not contact you about your account or the Service.

8. Retaining Your Information

We retain your Personal Information only for as long as is reasonably necessary for our legitimate business purposes. We will retain and use your Personal Information to the extent reasonably necessary to comply with our legal, accounting, or reporting obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes and enforce our legal agreements and policies. We also take into consideration the sensitivity of the data when determining its retention period.

9. Browser Signals

Do Not Track and Global Privacy Control (GPC)

Some web browsers have “Do Not Track” or similar features that allow you to tell each website you visit that you do not want your activities on that website tracked. At present, the Site does not respond to “Do Not Track” signals. In addition, at present, the Site does not respond to GPC signal requests to opt-out of website tracking.

10. Third Party Websites

We may post links to third party websites on our Service. Additionally, other materials made available through the Service may contain third-party website links or files. These third-party websites and files are not screened for privacy or security issues by Covered. We bear no responsibility for the information collected by any third-party website. Please review the privacy policy and terms of service for each site you visit through third party links.

11. Security Measures

The security of Your Personal Information is important to us. We design our systems with Your security and privacy in mind.

  • We work to protect the security of Your Personal Information during transmission by using encryption protocols and software.
  • We follow the Payment Card Industry Data Security Standard (PCI DSS) when handling credit card data.
  • We maintain physical, electronic, and procedural safeguards in connection with the collection, storage, and disclosure of customer personal information. Our security procedures mean that we may ask to verify your identity before we disclose personal information to You.
  • Our devices offer security features to protect them against unauthorized access and loss of data.
  • It is important for you to protect against unauthorized access to your password and to your computers, devices, and applications.Be sure to sign off when finished using a shared computer. 

We take reasonable and appropriate measures designed to ensure the integrity of our systems and protect your Personal Information. We regularly implement and update administrative, technical, and physical security measures to help protect Personal Information about You from unauthorized access, destruction or alteration. However, no method of transmission over the Internet or method of storing data is 100% secure. Therefore, we cannot guarantee absolute security.

12. Children’s Privacy

The Sites and Service do not knowingly collect Personal Information from Users who are under 18 years of age. You should not use the Sites or Service if you are not 18 years of age or older.  If we learn that we have collected information from a User under the age of 18, we will delete that information.
13. Your California Privacy Rights

The California Consumer Privacy Act (“CCPA”) requires us to provide specific disclosures about the Personal Information we collected in the preceding 12 months. This Privacy Policy describes the categories of Personal Information we collect and sources of information, and the business and commercial purposes for collecting Personal Information.

In the preceding 12 months, we have shared your Personal Information with each of the categories of third parties listed above for business and commercial purposes. In addition: 

  • We have sold the following categories of Personal information to service providers and financial services entity partners: commercial information, internet and other electronic activity information, Protected Classification characteristics, Direct Identifiers, certain information subject to protection under California law, geolocation data, audio, electronic, visual, thermal, olfactory or similar information; professional / employment-related information; and certain Sensitive Personal Information.  
  • We have sold or shared the following categories of Personal Information with our targeted advertising service providers and partners: Direct Identifiers, Internet Activity Information, and Profile Information.
  • We do not knowingly sell the Personal Information of minors under 16.

We have not sold consumers' personal information in the preceding 12 months for any monetary value. However, our use of certain website cookies may be considered a "sale" of information under California law. In the past 12 months, we may have disclosed your internet activity or geolocation with third parties whose cookies are on our websites. These cookies are used to:

  • Analyze usage of our website
  • Provide you with relevant advertising and products
  • Provide additional, dynamic functionality to our websites

14. Other State Privacy Rights

We provide residents of California, Colorado, Connecticut, Florida, Montana, Oregon, Texas, Virginia, and Utah with the privacy rights required under applicable law as further described below.

Consumer Privacy Rights:

If you are a resident of California, Colorado, Connecticut, Florida, Montana, Oregon, Texas, Virginia, or Utah, you may have the following rights, subject to any applicable exemptions or limitations:

  • The right to access. You may have the right to confirm whether we are processing your Personal Information and to access such Personal Information.
  • The right to correct. Certain states may afford you the right to request that we correct inaccurate Personal Information about you.
  • The right to delete. You may have the right to request that we delete your Personal Information under specific circumstances.
  • The right to opt-out. You may have the right to object or opt out of certain types of processing, including: (1) processing for the purpose of targeted advertising, (2) the sale of Personal Information, (3) processing for profiling and automated decision-making, (4) collection of Sensitive Personal Information.
  • The right to data portability. You may have the right to request a copy of your Personal Information in an accessible format.
  • The right to appeal.  If we do not grant your consumer request, you may have the right to appeal that denial.
  • The right to equal service. If you choose to exercise any of these rights, we will not discriminate against you in anyway. If you exercise certain rights, understand that you may be unable to use or access certain features of the Sites or our services or our products.

15. Submitting a Privacy Rights Request

If you are a resident of California, Colorado, Connecticut, Florida, Montana, Oregon, Texas, Virginia, or Utah, unless your requests are unfounded, excessive or repetitive, you may exercise your rights free of charge. Where required by applicable law, we will take steps to verify your identity before processing your request. We will not fulfill your request unless you have provided sufficient information for us to reasonably verify you are the individual about whom we collected Personal Information. We may request additional information about you so that we can match the information you provide to information we already maintain about you. We will only use the Personal Information provided in the verification process to verify your identity or authority to make a request and to track and document request responses, unless you initially provided the information for another purpose.

You may use an authorized agent to submit a request to know or a request to delete. When we verify your agent’s request, we may verify both your and your agent’s identity and request a signed document from you that authorizes your agent to make the request on your behalf. To protect your Personal Information, we reserve the right to deny a request from an agent that does not submit proof that they have been authorized by you to act on their behalf.

16. International Transfer

Your information may be transferred to—and maintained on—computers located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you are located outside the United States and choose to provide information to us, Covered transfers Personal Information to the United States and processes it there. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

17. Changes to this Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices. When we change this Privacy Policy, we will post the changes here and update the “Effective Date” of the Notice.  If we make material changes to this Privacy Policy, we will attempt to notify you and/or obtain your consent, as required by law.
